well, i came back from the Keys.. the urge to move into a tiny home and get a job at the Publix or something was strong. watching the sunset every night, star gazing, fishing, caught some sharks and fish, saw dolphins real close to boat and a manatee, swimming every day.. such a relaxing vacation.. no TV till the movie on the flight back.
we will be heading down a couple times a year now that we got a cool place to stay.
it was nice that i could watch the Sirrius star from the front porch for most of the evening before going to bed.

I go see a lawyer in 30 minutes. I only dealt with one once and it was a bad experience and he was a referral. He did a car crash case, not my fault and he really didn't care about my case so he didn't work very hard which sucks because it was NOT my fault in anyway at all. I even had the cops side of the story. This time the city rezoned my end of the street r2. The house next door was torn down and a giant hole dug and now there is a towering 4 story brick "duplex". Looks like an APT building. All single family homes in my area so it does not fit. Its ugly and takes up the entire lot. It ruined my view of town. I had put a second floor on this house just for a view of town and even put two large windows facing town. Now they face a WALL. Found out this is a loss and I have a case for restitution as my home value was harmed. I have proof of that too with a property reassessment. It shows my home went from a city appraisal of 211K down to 182K. That is 29,100 difference. I assume that is what we will seek unless I am advised differently. I am not a suing type but this is justified as the guy that built this monster next door has enough money to build it. I estimate the value to be around 2 million dollars he is sinking into these TWO buildings. Left side unit and right side unit 4 story big building and a left side right side two story below the big one. My main question is do we hold the city accountable? Is it the property owner? I feel the city is to blame for rezoning like they did. I never got a zoning notice either; I had left town and come back to find the giant hole where the house once was. My home is the ONLY DREAM to come true in my life. A house with a view. I had it for 4 years (the view). I have owned it almost 13 years. I have not realized any dreams otherwise hence me trying to compensate for the loss of said dream. Spring down here sure is nice ya'll!! Today is 68 degrees warm and breezy

My ex is going to install some new electric boxes in my house so I can put up a ceiling fan in my bedroom which will be really nice in the summer. And she fixed my bathroom heater the other night.

The rules are different everywhere but you could indeed have a case, typically when a town rezones an area they have to open it up to a public comment period and the town has to post public notice in news papers or in libraries and other public buildings. Also, a building that size likely required an environmental review prior to construction being approved, but from the timeline you describe I don't see how they could have completed that. From the limited info, I immediately wonder if some palms were greased at the zoning board, then again one thing I discovered by working in planning is that a lot of smaller municipalities don't even understand their own zoning rules, they just do whatever they want and then hope no one checks them on it or they retroactively change rules to cover their themselves.
Anyway, if you talk to a lawyer make sure he looks into whether or not the zoning board gave proper notice and if the builder completed a proper environmental impact review, also check whether the sewage management plan allows for a building that size with multiple units.
edit: also check into parking regulations, in some places certain sized buildings are required to have a certain amount of off-street parking, if they don't you could throw at least throw a wrench into them opening the building to tenants.

Miles- In addition to to what Lakai posted, check your city's comprehensive plan/general plan or whatever they call it. The rezoning should be consistent with this plan, and the plan should be the basis for the decision that is made. You may also want to check into the appeals/challenge period, in VA its 30 days from the decision, after that you have no recourse.
Something doesn't add up in your story, in VA the rezoning would have at least 2 public hearings with notifications sent to all adjacent property owners (sometimes further) for both hearings, signs posted on the proposed property for both hearings and ads in the paper for 2 weeks prior to the hearing. the rezoning process typically takes 6 months to a year. after that there is a site/construction plan process which takes another 4 -6 months and building permitting which can take a few months. there is no specific notice for the site and building plans for us.
Your recourse (if available) would be against the City, as they approved the rezoning/plans/etc. In theory your neighbor just built what was allowable.
Lastly I would consult with an attorney who specializes in land use, not one that you weren't impressed with in an easy accident case. If you need help picking one, look through some of the city's public hearing cases and see what attorney's represent people. You may also want to check with your other neighbors and have them join in.
Good Luck.
FWIW- I have been in planning in local gov. for about 7 years (have +10 years of private land development planning experience) and am now chief of planning for a county in VA. However none of my experience is in TN, so I don't know your state/local laws.

Oh well they are still determining if the previous landowner has any easements. What ever that is.
The dentist up the street had a guy build in front of his business and he got restitution from builder John Wise who blocked his dentistry with Apts. Wise is well known and has many litigation's against him. If Wise can be sued for blocking a business view then surely my case will hold up also.
One would hope. My hood just recently fought back against builders rezoning near them and they actually won it. Congratulations to them! How I wish it was not too late for me..
One man here battling a man with millions of dollars. I have worked my ass off for this house for so long and had my dream taken away with my view of town. It would be nice for the little guy to win something for a change, especially with this god awful administration we have who very obviously has a whole host of conflicts of interest.
Get in power in Gov't then manipulate the Gov't to further their own gains. Drain the swamp my ass. Fill it instead with special interest groups.

I was told my the law firm they cannot go against the city as it would be a conflict of interest and he didn't explain why. I assume its because they handle city cases at times. Thanks for the advice, I am not going to stop if one law firm says no.
